We rent a space for our restaurant that has water seep through walls when it rains hard. Do we have rights?

Our landlord wants us to arrange the needed services, and close without compensation during the repairs. The landlord also wants us to disassemble and move appliances at our expense to perform the repairs. There is carpet damaged as well, the landlord wants us to either paint or re-carpet the floor at our expense (they agreed to remove the damaged carpet which is in common area.) We have 1.5 years left in the lease. Do we have any rights here? What should we do?

    Rights to what?

    The landlord isn’t required to pay you while you’re moved out, and isn’t required to even MAKE the repairs.

    You need to look at your lease, and see what it says.

    If YOU bought “business interruption” coverage on YOUR insurance, then maybe you’ve got coverage under your policy. But your landlord isn’t obligated to pay you, and most likely your lease requires you to move the equipment for repairs.

    Read your lease. Most commercial leases require tenants to maintain the property fully. The only exception is shared things, items shared by multiple tenants.
